1. Agreement to Terms

By accessing or using Staging Spaces ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Staging Spaces is an AI-powered real estate staging platform that allows real estate professionals to:

• Upload property photos for AI-powered virtual staging
• Remove watermarks from listing images
• Receive professional staging recommendations
• Connect cloud storage accounts (Google Drive, Dropbox) to import and export images
• Monetize staged images through our advertising platform

3. Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

4.1 Permitted Use

You may use the Service for:

• Professional real estate marketing purposes
• Staging property photos you own or have rights to use
• Creating marketing materials for legitimate real estate listings

4.2 Prohibited Use

You may NOT:

• Upload images you do not own or have permission to use
• Use the Service for illegal, fraudulent, or deceptive purposes
• Misrepresent property conditions or staging in real estate listings
• Attempt to reverse engineer, decompile, or extract our AI models
• Use automated tools to scrape or download content at scale
• Upload inappropriate, offensive, or copyrighted content without authorization
• Interfere with or disrupt the Service or servers

5. Content Ownership and License

5.1 Your Content

You retain all ownership rights to images you upload ("Your Content"). By uploading images, you grant us a limited, non-exclusive license to:

• Process your images using our AI staging technology
• Store your images on our secure servers
• Display staged results to you
• Use anonymized, aggregated data to improve our AI models

5.2 Staged Images

AI-staged images generated by our Service are owned by you. However, you acknowledge that:

• Staged images must be disclosed as "virtually staged" in real estate listings (per MLS and NAR guidelines)
• You are responsible for ensuring staged images comply with local real estate disclosure laws
• We are not liable for how you use or present staged images

5.3 Our Intellectual Property

The Service, including our AI models, algorithms, software, and branding, is owned by Staging Spaces and protected by intellectual property laws. You may not copy, modify, or redistribute our technology.

6. Google Drive Integration

When you connect your Google Drive account:

• You grant us limited access only to files you explicitly select for import
• We may create a "Staging Spaces" folder in your Drive to export staged images
• You can revoke access at any time through your Google Account settings
• We comply with Google API Services User Data Policy and Limited Use requirements

7. Payments and Subscriptions

Some features require a paid subscription:

• Free Trial: New users may receive a free trial period as advertised
• Billing: Subscriptions are billed monthly or annually in advance
• Cancellation: You may cancel at any time; access continues until the end of your billing period
• Refunds: Generally non-refundable, except as required by law or at our discretion
• Price Changes: We may change pricing with 30 days' notice to existing subscribers

8. Advertising Platform Revenue Share

If you participate in our advertising platform (monetizing staged images with furniture brand placements):

• Revenue is shared 50/50 between you (agent) and Staging Spaces (platform)
• Payments are processed monthly for earnings above the minimum threshold ($100)
• You must provide valid tax information (W-9 or W-8) to receive payments
• We reserve the right to withhold payments for fraudulent activity or Terms violations

9. Service Availability and Changes

We strive to provide reliable service, but:

• The Service is provided "as is" without guarantees of uptime or availability
• We may modify, suspend, or discontinue features at any time
• We may perform maintenance that temporarily interrupts service
• We are not liable for service interruptions or data loss (maintain your own backups)

10. Disclaimers and Limitation of Liability

10.1 AI Accuracy

Our AI staging technology provides suggestions and automated processing, but:

• Results may not always be perfect or meet your expectations
• You are responsible for reviewing and approving all staged images before use
• We do not guarantee specific results or outcomes

10.2 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not liable for third-party services (Google Drive, Dropbox, Stripe, etc.)

11. Indemnification

You agree to indemnify and hold harmless Staging Spaces from claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights (copyright, privacy, etc.)
• Your misrepresentation of staged images in real estate listings

12. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your payment method fails or account is past due
• We are required to do so by law

Upon termination, you lose access to the Service and your data may be deleted after 30 days.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Your State/Country]. Any disputes will be resolved through:

• Good faith negotiation first
• Binding arbitration if negotiation fails (per AAA rules)
• Small claims court for eligible disputes

14. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
